The decision was reflected in a single ruling by the judge who highlighted that Lotocki was always within the law and that he is currently sentenced to four years of imprisonment "subject to the sentence becoming final, which until now has not happened."   On September 13, Fernando Burlando, lawyer for Silvina Luna's family, also requested the arrest of Lotocki "due to the complexity that the procedural situation has gained" for the doctor, but that request had not been resolved.   Another request was made by Attorney General Sandro Abraldes regarding the allegations of Pamela Sosa's complaints, also sponsored by Burlando; Gabriela Trenchi, advised by Nuria Drendak, and Stefanía Xipolitakis, with the legal representation of lawyers Gonzalo Díaz Cantón and Agustín Mariano Maya. Judge Edmundo Rabbione decided "not to accept" the request made by the prosecutor Lucio Herrera and the complainant because "the seriousness of the complaint and the accusations made require being extremely rigorous in the collection and evaluation of the evidence, before taking the very serious determination to order an arrest".
